1. PRIVACY POLICY

Local in the Know respects the privacy of their Local in the Know Web Toolkit users. We do not disclose or sell user account information to third parties. Your email will be used only to notify you about Local in the Know Web Toolkit-related news.
Local in the Know will not monitor, edit, or disclose the contents of a user's website unless obliged to do so by law or if such action is necessary to:
(i) protect and defend the rights or property of Local in the Know
or
(ii) fix or debug problems with the Local in the Know Web Toolkit software/service.

 

2. DISCLAIMER OF WARRANTIES
As User of the service you agree that the use of the service is at Users sole risk. The service is provided on an "as is" and "as available" basis. Local in the Know disclaims all warranties of any kind, whether express or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement.

Local in the Know makes no warranty that the service will meet your requirements, or that the service will be uninterrupted, timely, secure, or error-free. Nor does it make any warranty as to the accuracy or reliability of any information obtained through this service or that defects in the software will be corrected. You understand that any material/data downloaded or otherwise obtained through this service is done at your own risk and that you will be solely responsible for any damage to your computer system or loss of data that results in such a download.

No advice or information, either oral or written, obtained by you from Local in the Know shall create any warranty not expressly stated herein.

 

3. LIMITATION OF LIABILITY, INDEMNIFICATION
Local in the Know shall not be liable for:
(i) Any direct, indirect, incidental, special or consequential damages, resulting from the use or the inability to use the service.
(ii) Cost of procurement of substitute goods and services or resulting from any goods or services purchased or obtained or messages received or transactions entered into through this service.
(iii) Unauthorised access to or alteration of Member's transmissions or data, including but not limited to damages or loss of profits.
(iv) Statements or conduct of any third party on the service.
 

4. HOSTING SERVICES

Local in the Know Hosting Services are based on Annual Plans, and are non-refundable from date of transaction.
If a Hosting Service has already been performed, then it is non-refundable.


5. HOSTING FEES

Local in the Know Hosting Services are based on Annual Plans, and are non-refundable.
Hosting Fees are: $360.00 + HST = $414.00 per year, and will be billed yearly thereafter.
Note: If payment has not been received within 30 days of the date of the Hosting Invoice, it could result in deactivation of your account.
All data from your website will be deleted and your account terminated.


6. REFUND POLICY & SALES TERMS

All Local in the Know Hosting Services are paid plans that are year to year. And are non-refundable.


7. TRANSFER OF OWNERSHIP

It is the responsibility on the User to make transfer of ownership to the new User.

Local in the Know Hosting shall not be liable for:
(i) Any information conducted, transferred or shared between the existing User and the new User.
(ii) Domain Name ownership, Domain Name Registration, Domain Name Renewal or Domain Name Ownership Transfer.
Note: If the User has transferred ownership to a new User, it is the responsibility of the new User maintain ownership thereafter.


8. DOMAIN NAME, DOMAIN NAME REGISTRATION & DOMAIN NAME RENEWAL

It is the responsibility on the User to register (his or her) Domain Name with their Registrar. (ex: GoDaddy.com, NameCheap.com, etc.)
It is the responsibility on the User to renew (his or her) Domain Name with their Registrar. (ex: GoDaddy.com, NameCheap.com, etc.)


9. LAWS
The Local in the Know Web Toolkit Terms of Use shall be governed by and construed in accordance with the laws of Canada and the United States.
